Man with gender identity disorder's child not recognized
A husband who suffered from gender identity disorder and had his official family registry　changed from female to male is suing because the child he and his wife had through artificial insemination is not being recognized as their legitimate child by the courts. Claiming it is unfair, this is the first lawsuit of its kind in Japan. The couple who decided to file the lawsuit live in Osaka. The 29 year old husband was born a woman, but, after being diagnosed with gender identity disorder, changed his sex in the official family registry to male. Later, after getting married, and with sperm supplied by a third party, the couple had a baby boy, but their child's birth registration was not recognized. Two years later the child's name is still not on their official family registry. People with gender identity disorder have been allowed to change their sexes on their official family registries since 2004, and there have been cases of children resulting from these unions. However, children not related by blood do not receive legal recognition. Two years ago, Minister of Justice Chiba indicated he was considering changing the law, but nothing has happened. The couple will go to the ward office in Tokyo on the Jan. 27th and submit their child's birth registration. If it is not accepted they plan to sue in the family courts to have their child legally recognized.
There are over 2,000 people in Japan who have legally changed their sex on their family register, but according to a legal group this is the first lawsuit of its kind. The husband has said, "They allowed me to change my sex on my family register so I want them to recognize our child."
